1.Agreement

These terms form an agreement between you and Bytera (“we”, “us”, “our”) covering your use of the Roll the Rail mobile game for Android (“the game”). By installing or playing the game you accept these terms. If you do not accept them, please do not install the game, or uninstall it if you already have.

The game is distributed through Google Play, and Google’s own terms apply to that distribution in addition to these terms. Google is not a party to this agreement and is not responsible for the game.

Our Privacy Policy at https://play.bytera.in/roll-the-rail/roll-the-rail-privacy.html forms part of these terms and explains how the game handles information.

2.Who may play

The game is suitable for all ages, including children under 13. If you are under the age at which you can agree to terms of this kind in your country, you may use the game only with the permission and supervision of a parent or legal guardian, who accepts these terms on your behalf and is responsible for your use of the game. Parents and guardians are responsible for supervising a child’s use of the device and of the game.

The game requires no account, no sign-in and no personal information of any kind.

3.Licence to use the game

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the game on devices you own or control, for your own non-commercial entertainment. We keep all rights we do not expressly grant you here.

4.Things you must not do

You may not copy, sell, rent, sublicense, distribute or publicly perform the game or any part of it; modify, translate, decompile, disassemble or reverse engineer it, except to the extent the law expressly permits despite this restriction; remove or obscure any notice of ownership; use cheats, automation, memory editors, modified versions or any other method to interfere with how the game works or to obtain coins, stars or unlocked levels other than by playing; attempt to disrupt or overload any system we operate; or use the game in a way that breaks any law that applies to you.

We may stop providing the game to anyone who breaches these terms.

5.Coins, stars and other in-game items

The game includes virtual items: coins that you earn by finishing levels and spend on reversing the train or on unlocking trains in the shop, and stars that you collect on the track. These items exist only inside the game, have no monetary value, are not your property, cannot be exchanged for money or anything of value, cannot be transferred to another person or device, and are licensed to you rather than sold.

Your progress and your items are stored only on your device. If you clear the app’s data, uninstall the game, lose or replace your device, or if the stored data becomes corrupted, that progress and those items are lost permanently, and we cannot restore them or compensate you for them. We may also change the price, availability, behaviour or balance of items and levels at any time as the game is updated.

The game contains no purchases made with real money at the time these terms take effect. If we introduce paid items in a future version, we will publish updated terms covering payment, refunds and statutory rights before doing so.

6.Advertising

The game contains no advertising at the time these terms take effect. We may add advertising to a future version. Because the game is directed at an audience that includes children, any advertising will be served through a network certified for Google Play’s Families policy, and it will be non-personalised, as described in the Privacy Policy.

Advertisements are supplied by third parties. We do not control and are not responsible for the content of an advertisement, for any product or service it promotes, or for any dealings you have with an advertiser. If you see an advertisement in the game that appears inappropriate, please tell us at hello@bytera.in so that we can report it to the advertising network.

7.Updates and availability

We may update, change, add to, or remove features, levels, artwork, sounds or prices at any time, and we may suspend or stop offering the game altogether without notice. We do not promise that the game will always be available, that it will run without interruption or error, or that it will be compatible with every device, Android version or screen size. Your device’s manufacturer and operating system are outside our control.

8.Ownership

The game, including its code, level designs, artwork, models, logo, name, text and sounds, belongs to Bytera and is protected by copyright and other laws. The game also includes third-party open-source components, which remain the property of their authors and are used under their own licences: the three.js graphics library under the MIT licence, and the Baloo 2 and Nunito typefaces under the SIL Open Font License. Nothing in these terms transfers ownership of the game or of those components to you.

9.No warranty

The game is provided “as is” and “as available”, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. You use the game at your own risk and you are responsible for how you use your device while playing.

Nothing in these terms limits any right you have under a consumer protection law that cannot be excluded by agreement.

10.Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive loss, nor for loss of data, loss of game progress, loss of virtual items, loss of profit, or loss of goodwill, arising from or connected with the game, whether the claim is based in contract, negligence or anything else, and whether or not we were told such loss was possible.

Where liability cannot be excluded, our total liability to you for all claims connected with the game is limited to the greater of the amount you paid us for the game in the twelve months before the claim arose, or five hundred Indian rupees. The game is currently free, so in most cases that amount will be the latter.

11.Your responsibility

You agree to be responsible for your own use of the game and to cover any claim, loss or cost we reasonably incur because you broke these terms or used the game unlawfully.

12.Ending this agreement

You may end this agreement at any time by uninstalling the game. We may end it, or suspend your access to the game, if you breach these terms or if we stop offering the game. Sections that by their nature should survive — ownership, disclaimers, limitation of liability and governing law — continue to apply after the agreement ends.

13.Changes to these terms

We may update these terms when the game changes, most likely when advertising or paid items are introduced. The current version will always be available at https://play.bytera.in/roll-the-rail/roll-the-rail-terms.html with its effective date at the top. If you continue to use the game after an update takes effect, you accept the updated terms. If you do not accept them, please uninstall the game.

14.Governing law and jurisdiction

These terms are governed by the laws of India. The courts at Bargarh, Odisha, India have exclusive jurisdiction over any dispute arising from these terms or from the game, except that we may seek injunctive relief in any competent court to protect our intellectual property. Where the law of your own country gives you a mandatory right to bring proceedings locally, that right is unaffected.

15.General

If any part of these terms is found unenforceable, the rest continues to apply. If we do not enforce a provision straight away, that is not a waiver of it. You may not transfer your rights under these terms to anyone else; we may transfer ours if the game changes hands, in which case these terms continue to apply.
